BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES.
1. ACCEPTANCE OF TERMS
This Terms of Service Agreement (the “TOS” or “Agreement“) is a legally binding agreement that governs the relationship between you and Sweet Journey 17 Foundation, Inc., also referred to as “Sweet Journey 17,” the “Foundation,” “we,” “us,” or “our,” a non-profit organization located at 10055 Yamato Road, Boca Raton, FL 33498, together with our subsidiaries and affiliates, in connection with your use of the Foundation’s website and any related online services, applications, features, content, and resources that link to or reference this Agreement (collectively, the “Site” and the “Services“).
By accessing or using the Services, you represent and warrant that: (a) you have the legal capacity to enter into this Agreement; (b) you are at least eighteen (18) years of age, or you are accessing the Services under the supervision of a parent or legal guardian who agrees to be bound by this Agreement; and (c) your use of the Services will comply with this Agreement and all applicable laws, rules, and regulations.
This Agreement should be read together with our Privacy Policy, which is incorporated into this Agreement by reference and describes how we collect, use, and disclose information about you. By using the Services, you also consent to the practices described in our Privacy Policy.
2. DESCRIPTION OF SERVICES OFFERED
The Site is a non-profit website that serves as a resource to learn more about the Foundation’s mission, programs, events, and opportunities to help fulfill our mission of housing and supporting the families of hospitalized children and assisting families in need while their children are receiving medical care, and, where offered, to make donations in support of that mission.
Any and all visitors to the Site shall be deemed “users” of the Services for purposes of this Agreement. You acknowledge and agree that the Services made available through our website and applications — which may include mobile applications made available on various social media networking sites, platforms, and downloadable programs — are the sole property of the Foundation.
At its discretion, the Foundation may offer additional Services or products, or update, modify, or revise any current content and Services, and this Agreement shall apply to any and all additional, updated, modified, or revised Services unless otherwise stated. The Foundation reserves the right to cancel and cease offering any of the aforementioned Services or products at any time. You acknowledge, accept, and agree that the Foundation shall not be held liable for any such updates, modifications, revisions, suspensions, or discontinuance of any of our Services or products. Your continued use of the Services after the posting of any updates, changes, or modifications shall constitute your acceptance of such updates, changes, or modifications. You should therefore review this Agreement and all applicable terms and policies frequently to ensure you are aware of all terms currently in effect. Should you not agree to the updated, revised, or modified terms, you must stop using the Services immediately.
Furthermore, you understand, acknowledge, and agree that the Services are provided “AS IS,” and that the Foundation assumes no responsibility or obligation for the timeliness, missed delivery, deletion, or any failure to store user content, communications, or personalization settings.
3. ELIGIBILITY AND USER RESPONSIBILITIES
You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Services by, any third party. You agree not to:
a) use the Services in any way that violates any applicable federal, state, local, or international law or regulation;
b) impersonate or attempt to impersonate the Foundation, a Foundation employee, another user, or any other person or entity;

f) attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.
If you create or are provided with an account or credentials in connection with the Services, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

Due to the global nature of the internet, through the use of our network you agree to comply with all local rules relating to online conduct and acceptable content. The uploading, posting, or transferring of software, technology, and other technical data may be subject to the export and import laws of the United States and possibly other countries. 5. CONTENT PLACED OR MADE AVAILABLE FOR FOUNDATION SERVICES
The Foundation shall not claim ownership of any content you submit for inclusion on our Services. You hereby grant the Foundation the following worldwide, royalty-free, and non-exclusive licenses, as applicable:
a) For content submitted or made available for inclusion on the publicly accessible areas of the Foundation’s Services, a license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display that content on our Services for the sole purpose of providing and promoting the specific area to which the content was submitted. Those areas deemed “publicly accessible” areas of the Foundation’s Services are those areas of our network properties intended to be available to the general public, including message boards and groups that are openly available to users.
You represent and warrant that you own or otherwise control all of the rights to the content you submit, that the content is accurate, and that use of the content does not violate this Agreement or cause injury to any person or entity.
